What the law allows

West Virginia moved early. The legislature passed Senate Bill 415, the West Virginia Lottery Sports Wagering Act, in the 2018 regular session. It became law without the governor's signature on 9 March 2018, effective from passage. The Act was written so betting could start only after a change in federal law or a court decision, and only once the Commission published a notice in the State Register. The state had its law on the books and waiting.

The enrolled text of the Act ties sports wagering to the state's existing casinos: the four racetracks and the historic resort hotel, with up to five operator licenses. It also lets those operators take bets through an approved mobile or digital platform from anyone physically located in West Virginia. So you can bet at the counter or on your phone, as long as you're inside the state lines.

The West Virginia Lottery Commission regulates it and issues every license. The Act sets the age at 21.

What it means for a bettor in West Virginia

The location rule is the one that matters for anyone near a border. A book licensed here can only take your bet while you're in West Virginia, so the app checks where you are, and stepping into Ohio or Pennsylvania means betting under that state's rules instead.

Unlike some states, the 2018 Act doesn't carve out the home colleges; college games are on the list of sporting events it covers. I'd still check a book's board before assuming every game is there, because a book hangs only the numbers it wants to book. The Act also lets the Commission require the line "If you or someone you know has a gambling problem and wants help, call 1-800 GAMBLER" on every betting app and in every sportsbook.

Gambling winnings are fully taxable, whichever book pays them.

Where the offshore books fit

An offshore sportsbook holds no West Virginia license, and the Lottery Commission has no hold over it if it won't pay. A licensed book here answers to the Commission that licensed it. That's the trade I'd think about, more than any bonus. Our offshore sportsbooks section explains how those books work, and the VPN question covers why hiding your location is a bad idea.

If betting stops being a game, call 1-800-GAMBLER, and see our responsible gambling page.
